Conditions of Sale In these conditions of sale, John Walsh & Co., act as auctioneers and agents for the vendors and are called ìThe Auctioneersî and their representative conducting the sale is called ìThe Auctioneerî. Every person on the Auctioneerís premises shall be deemed to be there at their own risk and shall have no claim against the Company in respect of any loss or injury however caused, save in the case of said loss or injury being caused by direct negligence of the Auctioneerís employees. General Conditions 1. Whilst the Auctioneers make every effort to ensure the accuracy of their catalogue, each lot is sold by the vendor with all faults, imperfections and errors of description. 2. All statements as to authenticity, age, origin, condition or quality, whether printed or given orally are statements of opinion only and must not be taken as implying warranties or representations of fact. 3. The Auctioneer has absolute right to divide, combine or withdraw any lot(s), to refuse bids, regulate bidding or cancel a sale without giving reason or notice and may bid on behalf of the vendor for any lot subject to reserve or auctioneerís discretion. 4. The highest bidder shall be the buyer except in the case of dispute, in which case the auctioneer shall have absolute discretion to settle said dispute or re-offer the lot. 5. All lots are offered subject to any reserve price put on by the vendor but where there is no reserve price, the vendor has the right to bid personally or through another party, including the auctioneer. 6. Any conditions, descriptions or statements may be subject to variation by the Auctioneer, by announcement from the rostrum before accepting any bids. 7. If within seven days of the sale, the purchaser notifies the Auctioneer in writing and returns the lot, which is in his view, in the light of its description in the catalogue is a deliberate forgery, then the sale of that lot will be rescinded. The purchaser must satisfy the auctioneers that the lot is a deliberate forgery and the onus of proof is on the purchaser. In the case of any dispute, the parties agree to be bound by the decision of an arbitrator appointed by the Chairman of the National Association of Valuers and Auctioneers. 8. The Auctioneers are not responsible for default by any party as they act as agents for the vendor and do not therefore pay out until payment is received from the purchaser. Any verbal instructions are accepted at the senderís risk and must be confirmed in writing. 9. In the event of a sle by private treaty, all conditions of sale apply. VENDORS CONDITIONS 10. All goods delivered to John Walsh & Co. will be deemed to be delivered for sale by auction unless instructions otherwise are given in writing and each vendor agrees to be bound by the conditions of sale. 11. The Auctioneers themselves do not collect goods for sale but will instruct carriers on the vendorís behalf and at the vendorís risk to transport goods for sale, the costs of which will be deducted from the proceeds of sale. 12. John Walsh & Co. disclaim responsibility for loss or damage to goods or unauthorised removal of goods, unless caused by the direct negligence of their employees. 13. If any goods remain with the auctioneers longer than fourteen days after a request to remove them, then the auctioneers shall have an absolute right to sell them to defray costs and storage charges. 14. All goods in the Auctioneerís custody will be held insured against risks of fire, theft by forcible entry and water damage (but not against accidental breakage or damage) for which a charge of 1% will be deducted from gross sale proceeds. The Auctioneers shall not be responsible for any loss if the vendor notifies them in writing, not to hold the goods so insured. 15. All goods are sold without reserve at the Auctioneers discretion unless written instructions to the contrary are received prior to the sale. In the event of a lot being unsold at auction, the Auctioneers reserve the right to sell privately, subject to these conditions of sale. 16. The vendor shall indemnify John Walsh & Co. against any claims in connection with goods sold on their behalf. 17. Anyone delivering goods for sale which are the property of a person or body registered for V.A.T. shall notify the Auctioneers on or before delivery of the goods together with the vendors registered number. 18. The vendor authorises the Auctioneer to deduct commission and expenses from the sale proceeds and acknowledges the Auctioneers right to retain the buyersí premium , together with any discounts and interest. 19. The Vendor gives the Auctioneer the right to use any photograph of any lot, whether or not in connection with the sale. BUYERS CONDITIONS 20. Any person making a bid, does so subject to these conditions and acknowledges that they have satisfied themselves as to the condition of the lot. 21. Legal title to any lot(s) will not pass to the purchaser, until paid for in full and the Auctioneers shall be entitled to a lien until such payment is made. Notwithstanding the above, each lot is at the sole risk of the purchaser at the fall of the hammer. 22. Each buyer shall forthwith give his full name and address to the Auctioneer and pay such proportion of the price which the Auctioneer shall require and any failure to do so may result in the lot being re-offered at the discretion of the Auctioneer. 23. Every bidder shall be deemed to act as a principal unless there is a written agreement that he acts on behalf of a named principal 24. No purchase shall be removed until paid for in full and after the sale, when purchases shall be removed at the purchaserís risk and expense. 25. All goods shall be cleared by 4.00pm on the day following the sale, otherwise a storage cost of £2 per lot per day shall accrue. If the goods are not removed within 7 days, then the Auctioneer may re-sell them to defray the purchase price and any outstanding liabilities and recover any shortfall from the defaulting purchaser. 26. Payment shall be made by cash, Bankerí Draft or cheque supported by a Valid Cheque Guarantee card. Cheques drawn by third parties will not be accepted. 27. The purchaser shall pay the hammer price plus a premium of 15% of the hammer price excluding VAT . Click to Close-
