CONDITIONS OF SALE
DESCRIPTION AND WARRANTY: All statements made by the auctioneers or their staff are made without responsibility on the part of the vendors or the auctioneers. The purchaser is deemed to have inspected the lot he buys. Unless the auctioneer specifically announces otherwise, no warranty is meant or implied by any descriptions given. No member of the auctioneers’ staff has any authority to give any guarantee or warranty whatsoever concerning any of the lots. The terms of any warranty will be announced by the auctioneer as the warranted lot is offered. All other lots are sold ‘as seen’.
VARIATION OF LOTS: The auctioneers reserve the right to withdraw, consolidate or divide any lot or lots and to submit them in any order they may deem fit.
BIDDING: The highest acceptable bidder shall be the purchaser. If any dispute arises between two or more bidders, such dispute shall be resolved by the auctioneers as they see fit. The auctioneers reserve the right to refuse the bid of any person. No person shall advance a sum less than named by the auctioneer at the time of the sale. The vendor reserves the right to bid by himself or through his agent. The auctioneers act as principals.
PAYMENT: Each purchaser shall (if required) give his name and address to the auctioneer or his clerk and pay for each lot on the fall of the hammer. Payment by cheque will be accepted entirely at the auctioneers’ discretion. The auctioneers reserve the right to withhold any lot until such time as cheques have been cleared. All lots shall be paid for promptly at the end of the sale or before 5 pm whichever is the later.
RISK AND REMOVAL: Immediately on the fall of the hammer, each lot shall be at the risk of the purchaser. No lot (whether sold or not) shall be removed while the sale is in progress. No lot (whether sold or not) shall be removed except on production of written authority from the auctioneers. All lots shall be removed promptly at the end of the sale or before 5 pm on the day of the sale whichever is the later. Any lot not paid for and removed in accordance with these conditions may, at the auctioneers’ discretion, be resold and any loss incurred shall be made good by the defaulting purchaser together with all charges attending the resale. All good left, stored or exposed for sale at our premises remain entirely at the owners’ risk.
